O jusnaturalismo moderno

O objetivo desse artigo é analisar a tradição do jusnaturalismo moderno. Pretendemos mostrar como se pode falar de um “modelo” jusnaturalista. Essa ideia de “modelo” estaria baseada na existência de três noções comuns a toda essa tradição, a saber, estado de natureza, contrato social e sociedade civil. Analisaremos, então diversos pesadores, de Hobbes até Rousseau, a partir dessas três noções constitutivas do direito natural moderno. It is intended to show how we can talk about a jusnaturalist "model". This idea of a "model" would be based on the existence of the three shared notions of this tradition which are state of nature, social contract and civil society. Many thinkers, from Hobbes to Rousseau, will be analysed then, based on these three constitutive notions of the modern natural right.
